Community service for road rage attacker who broke three bones in driver's face

In a June 2024 decision, Judge Dara Hayes sentenced 45‑year‑old Graham Rosarius to 240 hours of community service for assaulting Samson Samuel with a tyre iron, resulting in three facial fractures. Rosarius, who has 11 prior convictions, pleaded guilty to assault causing harm on 15 September 2021. The incident occurred when Rosarius, driving a white van, confronted Samuel, a delivery driver, after a perceived traffic dispute. Rosarius grabbed a tyre iron and struck Samuel on the head, leading to emergency treatment at The Mater Hospital. The judge noted Rosarius's addiction history, recent rehabilitation, and low risk of re‑offending, deciding that custodial imprisonment was unnecessary. The sentence also considered a second count of producing the tyre iron during the dispute. The community service must be completed within two years.
