The Supreme Court refused John Hanrahan leave to appeal in a determination delivered on 29 July 2016, in a case brought by Irish Life and Permanent, trading as Permanent TSB.
Mr Hanrahan, the first-named defendant, wanted to appeal a ruling made by Finlay Geoghegan J. sitting alone in the Court of Appeal on 5 June 2015. The judge refused to vacate a hearing date but allowed him to file supplemental written legal submissions. The underlying dispute was his application for discovery of documents in summary proceedings, which the High Court refused on 24 November 2014.
The Court of Appeal heard the full appeal on 10 June 2015 and dismissed it, finding the discovery application premature.
The Supreme Court said the appeal from the June ruling had become moot because the main appeal had since been decided, so granting leave would be futile. It also noted that Mr Hanrahan had not filed the papers needed for the application, and had not responded to a letter of 24 February 2016 reminding him to do so.
Leave to appeal was refused.
