Man avoids jail for teen sex assaults on younger brother in 1990s

Outcome: Judge Martin Nolan said Stephen Ryan was aged between 12 and 15 when he carried out the offences on his younger brother, then aged between eight and 11. "The accused was a child himself; that's a strong mitigating factor," said Judge Nolan, handing down a three-year sentence but suspending it in full. The judge said he would suspend the sentence "principally by reason of the accused's age" and ordered Stephen Ryan to keep the peace and be of good behaviour for three years.
