A serious illness affecting a Court of Criminal Appeal judge has necessitated the re-hearing of several high-profile criminal cases. Chief Justice Susan Denham confirmed that Mr Justice Michael Hanna requires an extended period of convalescence and will be unable to continue in cases where judgment has been reserved. The cases affected include that of Anthony Lyons, a businessman whose conviction for violent sexual assault was found to be unduly lenient in November, though sentencing reasons remain outstanding. Also requiring re-hearing are appeals involving former priest Tony Walsh and other serious criminal matters. The court will schedule additional sittings to expedite proceedings. However, the case of Kevin McCardle of Carrickmacross, whose sentence for dangerous driving causing death was deemed unduly lenient at Monaghan Circuit Criminal Court, will proceed as judgment has already been delivered. The re-hearing of an appeal by brothers Warren and Jeffrey Dumbrell was scheduled for February 14th.
