The Special Criminal Court has rejected a defence application to adjourn the verdict in the trial of four men charged with the abduction and assault of Quinn Industrial Holdings executive Kevin Lunney until after a European Court of Justice opinion on related phone-data evidence is issued. The court, sitting at the Special Criminal Court in Dublin, heard that the verdict was due on Monday, 8 November 2021. Defence counsel argued that a pending CJEU ruling in the Graham Dwyer case, concerning the lawfulness of mobile phone data seizure under Irish law, could have implications for the accused if they were convicted. The prosecution submitted that the European process was not expedited and had been pending for two years. The three-judge court, comprising Mr Justice Hunt, Judge David McHugh, and Judge Gerard Griffin, found the application did not justify postponement. The four accused, including Luke O'Reilly from Cavan and three Dublin residents, all deny false imprisonment and assault causing serious harm to Mr Lunney on 17 September 2019 at Ballinagh, County Cavan.
