Agri-food plant extension opposed by estate owner

An estate owner in County Cavan has initiated High Court proceedings challenging An Bord Pleanála's approval of a planning extension for an agri-food manufacturing facility. John Moreharte, who owns Bellamont Castle and approximately 1,000 acres near Cootehill, seeks to overturn the board's March decision permitting Abbott Ireland to expand its infant milk product facility in Dromore, County Monaghan by some 2,661 square metres. Monaghan County Council had originally granted permission, which was subsequently appealed by both Mr Moreharte and An Taisce. The applicant contends the board's determination was flawed, arguing that an Environmental Impact Assessment should have been conducted given the facility's processing capacity exceeding 100 tonnes of raw material daily. He further claims the decision breaches EU Habitats Directive obligations. The judicial review seeks an order quashing the board's decision. Abbott Ireland and Monaghan County Council are notice parties to the proceedings. Mr Justice Charles Meenan adjourned the matter at the High Court in May 2022.
