Enoch Burke secures last-gasp injunction over dismissal appeal

A temporary High Court injunction halting an appeal hearing into a teacher's dismissal was granted on Thursday following an application brought in Tullamore, County Offaly. The appellant, who teaches at Wilson's Hospital secondary school in County Westmeath, sought to prevent the disciplinary appeal panel from convening on Friday, arguing that one panel member should recuse himself due to alleged bias regarding transgender policy matters. The appellant also contended that a video recording of a school service was material evidence that should have been provided to him and the panel in advance of proceedings. Justice Eileen Roberts found that fair issues had been raised and granted the temporary injunction on an ex-parte basis, noting that the respondents had received advance notice of the application. The judge made no findings of fact beyond determining that fair issues existed. The injunction remains in place pending a further High Court hearing scheduled for the following Tuesday. The case follows earlier legal proceedings concerning the appellant's attendance at the school premises.
