Two men in their seventies have been granted permission by the High Court to challenge their extradition to Northern Ireland in connection with a 1975 killing. John Edward McNicholl of Newmills, Letterkenny, and Seamus Christopher O'Kane of Scalestown, County Meath, face charges relating to the death of Constable Robert John McPherson, who was shot during an ambush in County Derry on 26 July 1975. McNicholl is charged with murder and attempted murder, while O'Kane faces firearms possession allegations. At the High Court hearing in Dublin, Mr Justice Patrick McGrath certified questions suitable for appeal consideration after finding that whilst authorities had furnished explanations for the substantial delay in pursuing extradition, those explanations contained significant gaps and extended periods where no action was taken. The judge declined to determine whether the near-five-decade interval between the shooting and the extradition request, or the omission to seek surrender on all original charges, amounted to abuse of process, instead referring the matter for appellate review. Both men escaped from the Maze Prison in May 1976 before their trial commenced. McNicholl has resided in Ireland continuously since 2003, and authorities made no attempt to seek his surrender until 2024. The lengthy dormancy in pursuing the case has become central to their defence strategy, with their legal representatives contending that the passage of time undermines the fairness of any subsequent prosecution. The men remain on continuing bail pending the appeal hearing. Their legal challenge represents the first substantive test of whether exceptional delay in seeking extradition can constitute an abuse of process under Irish and international law. The outcome will have broader implications for historical cases where fugitives have settled into ordinary lives in the Republic over decades without interference from foreign authorities.
