A 27-year-old man from County Galway has had his money laundering sentence significantly reduced following an appeal to the Court of Appeal. Brian Cummins, of Balgaddy Road, Tuam, originally received a five-year custodial term at Galway Circuit Court in July 2024 for offences contrary to the Criminal Justice (Money Laundering and Terrorist Financing) Act 2010. Mr Justice Michael MacGrath allowed the appeal and resentenced him to two and a half years imprisonment. Cummins had pleaded guilty to facilitating a €1,000 electronic funds transfer to an account nominated by organised crime figure Barry Young, known as "Tuam" in intercepted communications. The transfer followed criminal damage to a property in Tuam in October 2019. Gardaí uncovered the arrangement during a wider investigation into Young's criminal network, which operated across the northwest between 2019 and 2022. The appeal centred on proportionality. Defence counsel argued the original headline sentence of seven years, with two suspended, was excessive given the modest sum involved and Cummins's limited role in Young's broader enterprise. The applicant's age, background, and guilty plea were also cited as mitigating factors. Mr Justice MacGrath found the original sentence disproportionate. The Court of Appeal judgment noted the relatively small amount of money at issue and accepted that Cummins's culpability was considerably lower than that of Young, who was convicted at the Special Criminal Court of directing a 20-member criminal organisation and sentenced to eleven years in July 2023. Young's gang coordinated drug dealing, intimidation and money laundering across Sligo, Donegal, Leitrim and Galway. Gardaí recovered over €628,000 in drugs and €40,000 in cash linked to his operation despite his stated income being social welfare payments. The Director of Public Prosecutions had opposed Cummins's appeal, but the Court of Appeal's decision to halve the sentence reflects a reassessment of proportionality within the broader context of the case.
