Man who 'viciously' assaulted friend in front of child avoids jail

A 34-year-old man has received a two-year suspended sentence at Castlebar Circuit Criminal Court following his guilty plea to assault causing harm and possession of a weapon. The incident occurred at Cloonishlawn, Ballina, on 21 November 2023. The accused entered the victim's home and inflicted facial injuries including a deep cut around the eye through punching and headbutting. He subsequently produced a hammer from his car and placed it near the victim's face while making threats. A young child was present during the assault and sustained psychological trauma as a result. Judge Eoin Garavan noted the absence of evidence supporting the accused's claimed provocation and expressed concern regarding his propensity for violence. The headline sentence of three years was reduced due to mitigating factors, including the accused's previously crime-free record spanning 22 years and a probation assessment indicating low re-offending risk. He was ordered to pay €3,000 compensation, complete a Men Overcoming Violent Emotions course, and remain under Probation Service supervision for one year.
