Summary
The Director of Public Prosecutions has decided not to proceed with a third trial against a 31‑year‑old man who claimed he was acting in his sleep when he allegedly raped a friend. In the first trial in 2015 the case collapsed before a jury could deliberate. The second trial in 2016 ended with a hung jury after more than eight hours of deliberation and a month‑long trial. During the third trial, the prosecution counsel informed the judge that a jury would not be required and that a nolle prosequi would be entered on the single charge.
