Same mutation in samples from accused and two alleged victims, HIV trial hears
Summary
The trial of a 28‑year‑old African national accused of intentionally or recklessly infecting two women with HIV has reached its closing stages. The State alleges the accused was aware of his diagnosis when he infected the women, constituting serious harm. Evidence presented shows that virus samples from the accused and both complainants contained the same mutation. Dr Cillian De Gascun of the National Virus Reference Laboratory analysed the genetic sequences and found all three viruses were of the B‑type strain, with a specific mutation identified in a 2008 sample from the defendant, a May 2010 sample from one complainant, and 2010 and 2012 samples from the second complainant. While the comparison cannot confirm transmission from one person to another, it cannot be excluded. The trial is before Judge Martin Nolan and a jury of nine women and three men, with closing speeches scheduled for tomorrow. The unnamed 28-year-old pleaded not guilty.
