Fired worker tried to 'slip back under the radar' while manager was on holidays

Summary

Obasanjo Olajubu, who was dismissed from Wasdell Europe Ltd in July 2022, claimed unfair dismissal under the Unfair Dismissals Act 1977. He returned to the medicines‑packaging plant in September 2022, after the manager was on holiday, and worked for ten days before being told he had been fired. Olajubu argued that his dismissal was due to a traffic accident and a back injury that caused absences, and that the company had failed to send him a dismissal letter because of an administrative error. The Workplace Relations Commission found that Olajubu had been dismissed verbally in July, had insufficient service to bring an unfair dismissal claim, and that his re‑appearance in September was a deliberate attempt to "slip back under the radar." The tribunal rejected his unfair dismissal claim but ordered the company to pay €450 for notice pay under the Minimum Notice and Terms of Employment Act 1973. The decision was issued on 25 October 2023.
