The Labour Court rejected Dun Laoghaire - Rathdown County Council’s appeal and upheld a recommendation concerning a worker’s return from special leave. The worker, represented by the Services Industrial Professional Technical Union, had been assigned to roads maintenance and sought a return to refuse collection after losing earnings. The recommendation called for a meeting to establish whether permanent refuse-collection vacancies existed when he returned. If a vacancy was found, his claim was to be conceded, with compensation for losses and the applicable redeployment package. Any issue left unresolved after the meeting could be referred back to the Court. The decision was signed on 7 February 2000.
