In 2001, the Labour Court dismissed Tesco Ireland’s appeal and upheld a recommendation that a worker at its Shannon store receive a 7.5% chargehand differential from 1 February 2000. The decision was signed on 3 September 2001. The worker, represented by Mandate, had been receiving an extra £7.50 a week. Mandate argued that she managed the Off Licence department and should receive the differential paid to managers in comparable stores. Tesco Ireland said the Off Licence was not a designated department under its agreement and that the worker was paid as a sales assistant. The Court found local management considered her duties higher than those of a sales assistant. It upheld the recommendation in this individual case, with the differential to remain on a red-circled basis if Tesco continued to maintain that the post was not designated.
