The Labour Court affirmed a Rights Commissioner’s recommendation to reduce a worker’s final written warning to a written warning, and disallowed appeals by both the worker and Kerry Ingredients Ireland. The decision was signed on 25 November 2002. The warning followed the contamination of whey powder in May 2000. The Court agreed that the company was entitled to take disciplinary action and that mitigating factors favoured the worker. The recommendation said the warning’s duration should be dealt with under the House Agreement.
