The Labour Court varied a Rights Commissioner’s recommendation after a union appealed on behalf of a worker who lost his supervisory role when his worksite contract ended. The decision was signed on 20 October 2003.
The Rights Commissioner had recommended that the worker keep his supervisor’s allowance until the end of 2003 and be appointed to the next available supervisory position, subject to client approval. Securicor Security Services said no suitable supervisory post was available and that it would facilitate him when one became available.
The Labour Court broadly agreed with the earlier recommendation but added that discussions should begin at the end of 2003 on either a buy-out of the worker’s supervisory status or a severance agreement under Clause 24 of the company-union agreement. The Court did not order a severance payment; it varied the recommendation to include those options.
