The Labour Court varied a compensation recommendation in a worker’s appeal over a transfer from a city hotel, setting the sum at €7,500. The decision was signed on 1 June 2007. The worker had been moved after disciplinary proceedings concerning him and a supervisor resulted in a verbal warning. He said the transfer was unreasonable and overly severe because he lost benefits linked to the hotel post. Serco Services Ireland Limited said its enhanced contract allowed moves between sites and that free meals were a facility available to hotel staff, not a contractual benefit. A Rights Commissioner had recommended that the worker take the new IFSC posting and receive €2,000 for the loss of hotel meals. The Labour Court upheld that recommendation in principle but varied the compensation to €7,500, with the worker remaining at the new location, where it found a satisfactory working relationship and no outstanding disciplinary sanctions.
