The Labour Court upheld a recommendation that a worker return to his former Maintenance Manager role without loss of pay or status and receive €8,000 compensation. The recommendation followed a dispute with Saica Packaging Ireland over the worker’s redeployment to Corrugator Engineering Manager.
The Rights Commissioner had recommended the return and compensation after finding the company failed to honour an agreement made when the worker accepted the new role for a six-month probationary period. The worker appealed the recommendation. His union argued that he had given 30 years’ service and that the company was refusing to honour the agreement.
The Labour Court heard the appeal on 5 April 2012. Saica Packaging Ireland did not attend or send a representative. Relying on the appellant’s undisputed submissions, the Court upheld the Rights Commissioner’s recommendation. The determination was signed on 30 April 2012.
