The Labour Court recommended that HSE South restore a worker to her acting Grade Five Human Resources position and consider her under an agreement on regularising staff in acting posts. The decision was signed on 24 October 2012. The worker, a Grade Three clerical officer, had acted in the Grade Five role until the post was permanently filled while she was on maternity leave. Her union said she was not consulted or offered the permanent post; management said it followed normal recruitment procedures and selected a suitable candidate. The Court found she had been treated differently from comparable staff, unintentionally and unfairly, and said the parties should address restoration and regularisation through direct discussions.
