Labour Court rejects worker’s appeal in Inishowen Tourism Society bullying dispute

Labour Court ·

The Labour Court rejected a worker’s appeal in a bullying and harassment dispute with Inishowen Tourism Society Ltd, recommending renewed discussions about a proposed settlement. The decision was signed on 15 October 2014.

The Rights Commissioner had recommended an independent investigation but not compensation. Difficulties arose in appointing an investigator, and the employer later appointed a mediator. At a return-to-work meeting, the worker agreed to resign in return for a severance payment in full and final settlement, but the employer’s board did not sanction the proposal.

The Court found the working relationship had irretrievably broken down and recommended that both sides reopen discussions on that basis. It did not uphold the worker’s appeal.
