The Labour Court rejected a worker’s appeal against Debenhams Retail Ireland Ltd T/A Debenhams and upheld the recommendation that her claim for double time on a public holiday was not well founded. The decision was signed on 27 May 2015. The worker argued through Mandate that time off in lieu for earlier overtime should count towards the 37.5 hours required under her contract for double time. The company said she had to physically work those hours in the week of the holiday. The Court agreed that time off in lieu could not count towards the threshold. It said she had correctly received time-and-a-half for the holiday hours and an additional day off at another time.
