The Labour Court rejected Milena Madeja’s appeal for paid maternity leave and upheld the Rights Commissioner’s recommendation against her claim. The decision was signed on 3 November 2015. Madeja argued that her salary was linked to HSE scales and that she should receive maternity pay on the same basis as HSE staff. The Mid-Western Spina Bifida and Hydrocephalus Association said her contract did not provide for maternity pay. The Court found that the link to HSE scales applied to her annual salary, not other employment conditions, and accepted that she had no contractual entitlement to pay during maternity leave.
