Labour Court upholds £1,500 compensation recommendation on worker’s appeal

Labour Court ·

The Labour Court upheld a recommendation that Agricultural Credit Corporation PLC pay a worker £1,500 and advance him by two average increments, after the Amalgamated Transport and General Workers Union appealed. The decision was dated 20 July 1988.

The worker’s Farm Credit Control post was abolished after he temporarily transferred to Naas. Management had given him a written guarantee that the post would be retained for him. The union sought compensation for the lost position and promotion prospects, and argued the Rights Commissioner’s recommendation was inadequate. The Corporation said the recommendation represented a permanent £1,400 annual increase and that the worker had moved to an equivalent-grade Internal Audit role.

The Labour Court found no grounds to alter the Rights Commissioner’s recommendation. It upheld the £1,500 payment and two-increment advancement, which the Rights Commissioner had recommended as full and final settlement, subject to the worker accepting one of two management options.
