The Labour Court left in place a Rights Commissioner’s recommendation that a worker was not victimised in a dispute over an order assembler vacancy at P.E. O’Brien & Sons Limited. The decision was signed on 30 November 1989, after an appeal by the Irish Transport and General Workers’ Union. The Court found the company had initially breached its agreement on filling vacancies and had been less than considerate in how it sought to fill the job. It noted that the company later followed the agreed procedures and found no substantial grounds to change the recommendation. The Rights Commissioner recommended that the worker accept he was not victimised and that the company keep a record of his interest, service and work record for the next vacancy. The union argued the job should have been advertised and that the worker felt victimised. The company said it considered three applications and chose the most suitable candidate.
