In 1989, the Labour Court upheld Acco (Ireland) Limited’s appeal and confirmed the appointed worker in a materials handler position. Its decision was signed on 11 December 1989, following the company’s appeal against a Rights Commissioner’s recommendation to reopen the appointment. The Irish Transport and General Workers’ Union had argued that the appointee lacked the forklift training required for the job. The Court found that assertion incorrect and said the amount of forklift driving involved had also been seriously challenged. It considered that new evidence at the hearing had significantly changed the case presented to the Rights Commissioner.
