In 1990, the Labour Court upheld a Rights Commissioner’s recommendation in the Irish Nurses Organisation’s appeal against National Association for Cerebral Palsy Ireland Limited. The decision was signed on 6 February 1990. The dispute concerned premium pay for a registered general nurse employed as a child care assistant at Marino Clinic in Bray. The Rights Commissioner recommended £50 for additional responsibilities but rejected her claim for night-duty premiums. The union argued she performed nursing duties on night shifts and estimated her loss at about £650. The association said her salary scale already included an allowance for night and weekend work. The Court said the recommendation should stand, taking account of the clinic’s general conditions and the additional increments paid for the worker’s qualifications.
