The Labour Court overturned a Rights Commissioner’s constructive-dismissal finding against Invotron Limited on a worker’s appeal, but increased her existing ex gratia payment from £750 to £1,500. The decision was dated 27 March 1991.
The worker had worked part-time as a book-keeper. After Invotron offered her a full-time post at £12,168 a year, she rejected the offer and her employment ended on 19 October 1990. She argued that changes to her hours and pay had forced her out; the company said the part-time role had grown into a full-time post and she rejected the new position.
The Court found no grounds to conclude that she had been constructively dismissed and rejected her appeal. It raised the £750 already paid, citing her co-operation when her employment ended. The earlier recommendation of an additional £2,000 was overturned.
