The Labour Court allowed Cafe Society’s appeal and set aside a Rights Commissioner’s recommendation of compensation for a worker’s alleged unfair dismissal. Signed on 23 August 1991, the decision found that the worker was still on probation and that the Rights Commissioner had erred in finding unfair dismissal and recommending compensation. The Court decided that no compensation should be granted.
