In 1992, the Labour Court upheld a Rights Commissioner’s recommendation in a worker’s appeal against Duffy Meats, subject to a variation: if the company did not offer her re-employment by 1 December 1992, it should pay her £250 that day. The decision was signed on 7 August 1992. The worker had been dismissed during probation over her attendance record. She argued that some absences were non-recurring and that she had not obtained a reference from the company. Duffy Meats said she had been absent for 16 days over four occasions and that her attendance was unacceptable. The Court also expected Duffy Meats to provide an appropriate reference without delay.
