In 1992, the Labour Court rejected a chef’s appeal against his dismissal from La Fiesta, leaving the Rights Commissioner’s findings unchanged. The decision was signed on 18 August 1992. The worker said he had missed work while ill, was dismissed after reporting back and had received no formal warning. La Fiesta said he had repeated attendance and lateness problems and had been warned that another incident could lead to dismissal. The Court found no grounds to alter the Rights Commissioner’s findings. It said La Fiesta should arrange for outstanding holiday and notice issues to be resolved and provide the worker with a P45.
