In 1993, the Labour Court rejected the Irish Distributive and Administrative Trade Union’s appeal and upheld the Rights Commissioner’s recommendation that the worker and union accept the redundancy settlement as fair and reasonable. The decision was signed on 14 October 1993. The union sought an improved payment, arguing that the worker was not fit to negotiate while taking medication and that a former employee with less service received a slightly higher pension lump sum. Frawley’s said the worker freely entered the agreement, which included statutory redundancy, a company lump sum and pension entitlement.
