The Labour Court upheld a Rights Commissioner’s recommendation requiring Potterton Myson Limited to pay a worker one week’s pay. The decision was signed on 28 July 1994. The Court also noted that the worker’s final warning had been deleted and said the parties should ensure there was no victimisation if he returned to work. Mandate appealed the recommendation. It said the worker had been accused of threatening behaviour and subjected to ongoing harassment. Potterton Myson Limited said the warning had been removed and the week’s pay was available. The Court found there was no intention by the worker to harass staff.
