In 1995, the Labour Court upheld a Rights Commissioner’s recommendation on appeals by Delta Security and the Amalgamated Transport and General Workers Union. It found the worker had received no specific reasons for being moved from his supervisory post at Beaumont Hospital and no reasonable opportunity to respond. The decision was signed on 19 May 1995. The Rights Commissioner had recommended that the worker return to the supervisor role and receive compensation for lost earnings. The Labour Court upheld that recommendation and said the parties should agree compensation for the period he was removed from the post. The union sought compensation for reduced salary and additional travel costs. Delta Security said the hospital had required the transfer and that the company could not control the worker’s financial losses.
