Labour Court reinstates chargehand after Power Supermarkets disciplinary failure

By Rory Hanlon

Labour Court ·

The Labour Court changed the Rights Commissioner’s recommendation after Mandate appealed on behalf of a chargehand at Power Supermarkets Limited. In a decision signed on 9 August 1995, it found the worker had committed misconduct but was unfairly treated because the company failed to follow its disciplinary procedures. The Court recommended reinstating him as a chargehand at the Upper Baggot Street branch, converting his unpaid suspension to paid suspension and issuing a written warning under the company’s procedures. The earlier recommendation had included a transfer to Kilbarrack; the Labour Court’s remedy instead returned him to his former position.
