The Labour Court upheld a Rights Commissioner’s recommendation giving a Penney’s Limited worker three more months to show she was fit to return to work. The decision was signed on 28 May 1999. The sales assistant at the Dundalk branch had been absent since August 1995. Mandate sought three years’ leave or, alternatively, a severance payment. Penney’s said it had kept her job open and had no medical indication of when she could return. The Court found the company had acted reasonably under its absence procedures and saw no basis to overturn the recommendation. It disallowed Mandate’s appeal.
