Labour Court rejects Telecom Eireann worker’s claim for share plan and bonuses

By Fionn Kelly

Labour Court ·

The Labour Court upheld a Rights Commissioner’s recommendation that a Telecom Eireann worker had no entitlement to the company’s employee share plan or productivity bonus. The decision was signed on 18 June 1999. The worker retired in 1998 and argued that the share plan had deprived him of bonuses for 1996–97 and 1997–98. Telecom Eireann said a collective agreement ended the bonus scheme and limited share plan participation to employees serving on or recruited after 1 November 1998. The Court said the worker could reasonably have expected some benefit to offset the lost bonuses. But the collective agreement discontinued the bonus scheme without linking it to the later share plan, so the Court disallowed the appeal.
