The WRC found a fuel-station deli assistant’s dismissal unfair and awarded him €3,000 in compensation, plus €2,535.75 for minimum notice. The decision was dated 8 March 2016. The worker admitted serving himself fuel and eating wasted stock, but argued the investigation and dismissal process were flawed. The employer said the dismissal followed breaches of its meal, cash-handling and honesty policies, including an incident involving money taken from a charity box. The adjudication officer found reasonable grounds for the employer’s belief that procedures had been breached, but concluded that dismissal was outside the range of reasonable responses. The officer cited the difference between the dismissal letter and the employer’s later account of the allegations, and found the worker’s length of service had been held against him. Compensation took account of his contribution to the dismissal and his new employment.
