The WRC awarded a gym instructor €3,666.92 after finding breaches involving rest breaks, employment terms and unpaid class payments, as well as sexual harassment and aggressive hectoring. Adjudication Officer Kevin Baneham dated the decision 16 June 2016.

The gym instructor said she struggled to take breaks, had not received a contract and was sexually harassed. A hotel and leisure centre disputed that she had been denied breaks or lacked a contract, and denied agreeing to pay extra for classes.

The officer found the hotel’s records showed breaks on only 40 of 150 eligible days. He also found its unsigned contract had not been shown to have been provided, that her report of sexual harassment to HR was not adequately addressed, and that she faced aggressive hectoring on 1 October 2015.

The awards were €1,512 for the employment terms breach, €990 for missed breaks, €164.92 in class payments, €800 for sexual harassment and €200 for hectoring. The harassment and hectoring findings were made under the Industrial Relations Acts.
