The Workplace Relations Commission dismissed a Polish man’s complaint against an insurance company over motor insurance pricing, finding it frivolous and vexatious. The decision, dated 25 October 2016, did not decide whether the pricing was discriminatory.
The man said the same details produced a quotation about 45% higher when he entered a Polish-issued EU licence than when he entered an Irish licence. The company said it could not verify penalty points on non-Irish licences and relied on risk and underwriting factors.
The adjudication officer found he had no intention of changing his existing policy and had made an artificially constructed claim to test legal points. The complaint was dismissed on that preliminary ground; the merits were not decided.
