The WRC ordered a North South Body to reimburse a finance manager €316.88 for unlawful pension deductions in April 2015 and repay all later unlawful deductions. The decision was dated 21 June 2016. The worker’s pension contribution was set at 1.5% under his contract, but it rose to 7.35% from April 2015. The employer argued the increase was authorised by law after amendments to the scheme agreed by the North-South Ministerial Council. The adjudication officer found the scheme and its amendments did not have statutory force in Ireland. He found the employer had unlawfully deducted 5.85% of the worker’s wages each month from April 2015.
