The Workplace Relations Commission dismissed two race discrimination complaints brought on behalf of a former student against a private school, finding no racial motive in the treatment he complained of. Adjudication officer Aideen Collard dated the decision 14 March 2017.
The student’s parents said another student had racially abused him and alleged discriminatory treatment by teachers, including classroom seating, a locker move and a school report. The school denied discrimination, saying it had addressed the incidents and that other actions were related to managing his conduct.
Collard found that another student had made one racist comment in September 2014 and that the school had addressed the incident appropriately. She accepted the school’s explanations for the other complaints, including that the student was moved in class to maintain order and that his locker was moved because of his conduct. She found that the complaints did not establish discrimination on the ground of race and dismissed both.
