The Workplace Relations Commission awarded a general operative €35,000 after finding he was unfairly dismissed by a manufacturer. The decision was dated 15 June 2016.
The employer said it dismissed the worker after repeated bullying complaints. The WRC found that earlier allegations had not been upheld and were revived years later without being put to the worker during the investigation. He could not challenge them before his dismissal.
The WRC also found there was no separate disciplinary hearing, the suspension appeared punitive and the employer never issued a decision on the worker’s appeal. It ordered compensation because there was no longer enough trust to sustain the employment relationship.
