WRC awards worker €20,000 after manufacturing company fails to accommodate disability

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission found that a manufacturing company discriminated against a worker by failing to provide reasonable accommodation for her disability, and ordered it to pay her €20,000. The decision was dated 23 March 2017.

The worker sought a temporary day shift because her five-cycle swing shift aggravated her depression. The company said day shift positions were limited and cited the training and replacement costs of accommodating her. The adjudication officer found it treated the request as an ordinary transfer application despite medical advice that she needed day work. It also provided no evidence specific to its Irish operation’s finances to show that the accommodation would impose a disproportionate burden. The officer concluded that the company breached its duty to provide reasonable accommodation under the Employment Equality Acts.
