WRC rejects six complaints after finding Regional Claims Manager was not an employee

By Gráinne Nolan

Workplace Relations Commission ·

The Workplace Relations Commission rejected six complaints by a Regional Claims Manager against an insurance company after finding he was an independent contractor, not an employee. The decision was dated 12 April 2017. The company argued that the complaints could not proceed because the man was self-employed and worked mainly outside Ireland. The adjudication officer rejected the company's separate argument that his residence and work location barred the complaints from being heard. The officer found that the working relationship did not make him an employee. He invoiced for completed claims, was paid for each one, and did not receive holiday or sick pay. He could also decline individual cases without adverse consequences. The six complaints, under employment, wages, working time and transfer of undertakings laws, were found not well founded because he was not an employee.
