WRC recommends 39-hour contract and €500 redress for store assistant

Workplace Relations Commission ·

A Workplace Relations Commission adjudication officer recommended that a supermarket give a store assistant a 39-hour contract, backdated to 5 February 2015, and pay her €500 redress. The recommendation was dated 11 November 2016. The dispute concerned her claim to a higher band of hours under a collective agreement. The complainant said she had regularly worked 39 hours a week. The supermarket said the extra hours reflected seasonal demand and exceptional circumstances. The officer found that annual leave should count and that, including it, she had worked 39 hours per week over the relevant period. The officer also said it was not readily discernible whether the reduction in her hours was linked to her grievance.
