A WRC adjudication officer found that a general operative was not dismissed and rejected his unfair dismissal complaint. The decision was dated 12 August 2016. The worker said he was accused of using company fuel and told there was no job for him. The employer said it asked him to attend its head office for an investigation and that he did not return to work. The officer accepted the employer’s account, noting requests for him to attend and letters seeking to investigate the incident. The minimum-notice claim also failed because there had been no dismissal. No decision was required on the redundancy claim because no claim was presented under that Act.
