WRC awards worker €1,680 for constructive dismissal

By Tadhg O'Sullivan

Workplace Relations Commission ·

The Workplace Relations Commission awarded a worker €1,680 after finding he was constructively dismissed. The decision was dated 21 October 2016. The worker said his workload was excessive, his requests for help went unanswered and he resigned after his health suffered. The employer relied on its grievance procedures and said it had encouraged him to reconsider resigning and offered support. Adjudication officer John Tierney found the worker had raised genuine difficulties repeatedly without resolution. He preferred the worker’s evidence and found that the employer’s failure to provide a duty of care led to the constructive dismissal. The award was €1,680 in compensation.
