A worker was entitled to four weeks’ wages after the Workplace Relations Commission found that a cleaning services company failed to consult meaningfully over a contract transfer. The decision was dated 1 December 2017. The cleaner and supervisor at a third-level college said the company issued her a P45 and failed to pay redundancy, wages, annual leave and notice. The company argued her job transferred to the new contractor and continued. The WRC rejected her redundancy, unfair dismissal, payment of wages, annual leave and continued-employment complaints, finding that her employment transferred. It found the company’s consultation was minimal, with no meaningful engagement with the worker and her representatives, and required it to pay four weeks’ wages. Three duplicate complaints were dealt with as part of that consultation finding.
