The Workplace Relations Commission found a chef’s unfair dismissal complaint was not well founded in a decision dated 4 November 2016. The adjudicator preferred the takeaway’s evidence that it had paid wages. The chef said he left after not receiving wages and alleged his boss used abusive language, assaulted him and threatened to cancel his work permit. The takeaway said he had been paid, received a return of his visa payment and left voluntarily. At a resumed hearing, the chef offered no further supporting evidence, while the takeaway provided a contract and bank records showing payments. The adjudicator found the evidence substantially contradicted the chef’s claim that no wages had been paid.
